You can be charged in several ways
As a CDL driver, there are four possible DUI charges you could be charged with: DUI Per Se, DUI Per Se Commercial Vehicle, DUI Per Se Drugs, DUI Less Safe Drugs, and DUI Less Safe. Under Georgia Law, it is illegal to drive while operating a commercial vehicle with a .04% or higher BAC. Even if you weren't operating a commercial vehicle, if you tested .08% BAC or higher, you could be charged with DUI Per Se. Per Se charges mean the state does not have to show impaired driving, but just have to prove that you did drive with that level of blood alcohol content. If you took a blood test, you could be charged with DUI Per Se Drugs if your blood results show you were under the influence of illegal drugs. If you refused the state administered test, you could be charged with DUI Less Safe or DUI Less Safe Drugs. That means the state has to prove that you were driving less safe due to being impaired than you if you had not been impaired. This can be due to impairment from alcohol, prescription drugs, or illegal drugs.
Will my license be suspended? What other penalties am I facing?
If you refuse the state administered test, your Georgia CDL will be suspended for at least one year. This suspension includes driving commercial and non-commercial vehicles. Upon conviction, you could be facing a one year suspension.
