What is bond or bail?<\/h3>\n

Bail is the money a defendant must pay in order to get out of jail.\u00a0 Bond is what is posted on a defendant's behalf to secure his release, usually by a bail bonding company.\u00a0 Typically, the terms are used interchangeably.<\/p>\n

When a person is arrested and charged with an offense, they can only get out of jail by posting bail or obtaining a bond.\u00a0 A judge determine the amount of bail to set based on the individual characteristics of the case.\u00a0 The judge may look at: criminal history of the offender, risk to re-offend, risk of intimidating witnesses, risk of fleeing the jurisdiction, and the seriousness of the offense.\u00a0 A judge may deny bail or set an amount that is unreasonable.<\/p>\n

Bail is a way of securing a defendant's agreement to return to court and to abide by certain conditions.\u00a0 If the defendant fails to appear or violates the terms of the release, the state can move for bond forfeiture.\u00a0 If that is the case, then the defendant could lose the money placed for bond and face being placed back in jail.<\/p>\n
